Three-deckers are allowed to be banned by cities and towns.

Massachusetts legislature adopts the so-called Tenement Act. Reputedly spurred by the anti-immigration movement, the local option law is meant to discourage the construction of three-deckers or triple-deckers by allowing municipalities to ban construction of “wooden tenements . . . [in which] cooking shall be done above the second floor.”
